Report by the Executive Director of UNEP
1. Article 24 of the Convention on Biological Diversity establishes a secretariat with the following functions:
(a) To arrange for and service meetings of the Conference of the Parties;
(b) To perform the functions assigned to it by any protocol;
(c) To prepare reports on the execution of its functions under the Convention and present them to the Conference of the Parties;
(d) To coordinate with other relevant international bodies and, in particular to enter into such administrative and contractual arrangements as may be required for the effective discharge of its functions;
(e) To perform such other functions as may be determined by the Conference of the Parties.
2. Resolution 2 on international cooperation for the conservation of biological diversity and the sustainable use of its components pending the entry into force of the Convention on Biological Diversity, adopted by the Conference for the Adoption of the Agreed Text of the Convention on Biological Diversity, requested the Executive Director of the United Nations Environment Programme to provide the secretariat to the Convention on an interim basis until the Convention had entered into force.
3. Article 40 of the Convention, on secretariat interim arrangements, states that the secretariat to be provided by the Executive Director of the United Nations Environment Programme shall be the secretariat referred to in article 24, on an interim basis for the period between the entry into force of the Convention and the first meeting of the Conference of the Parties.
4. UNEP Governing Council decision 17/30 of 21 May 1993 established the Intergovernmental Committee on the Convention on Biological Diversity and requested the Executive Director to convene its meetings.
5. The present paper reflects, for the information of the first meeting of the Conference of the Parties, the measures taken by the Executive Director in response to the request of Governments in resolution 2 of the Nairobi Final Act and to discharge the mandate in article 40. It briefly reviews the nature and range of activities carried out by the Interim Secretariat since its inception in October 1993 until the first meeting of the Conference of the Parties.
6. The Interim Secretariat of the Convention on Biological Diversity was established by UNEP in accordance with the relevant provisions of Governing Council decision 17/30 of 21 May 1993 in response to resolution 2 of the Nairobi Final Act.
7. The Government of Switzerland undertook, through an Agreement with UNEP dated 22 December 1992, inter alia:
(a) To provide accommodation for the Interim Secretariat, for the period from June 1993 until at least twelve months after the first meeting of the Conference of the Parties;
(b) To bear the full annual cost of the Interim Secretariat;
(c) To provide conference facilities for large meetings held in Geneva.
8. According to section 4 of UNEP project document BV/6105-93-02(3052), the Interim Secretariat is responsible for the following specific activities:
(a) Ensuring effective implementation of the resolutions of the Conference for the Adoption of the Agreed Text of the Convention on Biological Diversity;
(b) Organizing meetings of the Intergovernmental Committee on the Convention on Biological Diversity and implementing its decisions;
(c) Promoting the ratification of the Convention;
(d) Establishing a network with relevant intergovernmental, non-governmental, regional and international organizations and secretariats of other international conventions; and
(e) Preparing for the first meeting of the Conference of the Parties.
9. Pursuant to Governing Council decision 17/30, the Executive Director of UNEP in June 1993 set in motion a process to select staff for the Interim Secretariat. General support staff were hired during the period June to August 1993. The other positions were advertised for three and a half months, after which period a final selection was made and the staff took up their duties on 27 September 1993. The Executive Secretary was appointed on 1 October 1993. Up to the time of the second session of the Intergovernmental Committee, the composition of the Interim Secretariat was as follows:
(a) An Executive Secretary, responsible for overall management and leadership of the group including the direction of the technical work;
(b) Five Professionals specializing in life sciences, biotechnology, law, economics and financial institutions;
(c) A Junior Professional Officer (P-2) who assists in research related to economic aspects of the work in progress, provided by the Government of Italy since February 1994;
(d) Two Professionals on short-term assignments, assisting with research and with communications;
(e) Seven General Service staff and, for short periods, two interns.
10. In view of the heavy workload involved in preparing, especially in an extremely short time frame, for the Open-ended Intergovernmental Meeting of Scientific Experts, the second session of the Intergovernmental Committee and the first meeting of the Conference of the Parties, the capacity of the Interim Secretariat was supplemented by six short-term consultants for a total of 24 person/months during the period February- November 1994. Two additional short-term consultants were contracted for a total of five person/weeks in August 1994 to assist in analysing information and communications needs for the secretariat to the Convention and to advise on the mechanisms and media through which those needs might be met.
11. During the reporting period, the Interim Secretariat prepared, organized and serviced three major intergovernmental meetings:
(a) The first session of the Intergovernmental Committee on the Convention on Biological Diversity, held in Geneva from 11 to 15 October 1993;
(b) The Open-ended Intergovernmental Meeting of Scientific Experts on Biological Diversity, held in Mexico City from 11 to 15 April 1994, pursuant to the recommendation of the Intergovernmental Committee at its first session;
(c) The second session of the Intergovernmental Committee on the Convention on Biological Diversity, held in Nairobi from 20 June to 1 July 1994.
12. The first meeting of the Conference of the Parties is the fourth major intergovernmental meeting prepared, organized and serviced by the Interim Secretariat. Preparation of these meetings was facilitated by the catalytic work initiated by UNEP through the organization of Expert Panels, by the contribution of its officers to the technical papers and by the services provided by its Conference Service. The work of the Interim Secretariat was also facilitated by the support received from other organizations, as reflected in section IV of the present report.
13. For each substantive item on the agendas of these meetings, background papers and reports were prepared. The reports of the three meetings referred to in paragraph 11 above are contained, respectively, in documents UNEP/CBD/COP/1/3, UNEP/CBD/IC/2/11 and UNEP/CBD/COP/1/4. A list of the documentation prepared by the Interim Secretariat for these intergovernmental meetings is contained in annex I.
14. In addition, during these intergovernmental meetings, the Interim Secretariat organized and supported the daily meetings of the Bureau, as well as two meetings of the Bureau of the Intergovernmental Committee, in Geneva on 4 February 1994 and in Nairobi on 19 June 1994, in relation to preparation for the Intergovernmental Meeting of Scientific Experts and the second session of the Intergovernmental Committee.
15. The Interim Secretariat also coordinated contributions of funds and arranged for the participation in these intergovernmental meetings of developing countries and countries with economies in transition. Generous contributions were received from the Governments of Australia, Canada, Denmark, Germany, Japan, Norway, Sweden, Switzerland, United Kingdom, United States of America, and the European Community.
16. Similar efforts have been undertaken to enable the participation of developing countries and countries with economies in transition in the first meeting of the Conference of the Parties.
17. At its first session, the Intergovernmental Committee requested the Interim Secretariat to mobilize funds for the convening of regional workshops on the Convention on Biological Diversity. In response to this request, the Interim Secretariat prepared project proposals for fund raising for the regional workshops and approached relevant Governments and international and regional intergovernmental organizations.
18. During the reporting period, the Interim Secretariat, as requested by organizing countries or organizations, assisted in preparing and/or participated in the following regional workshops:
(a) Workshops organized in collaboration with the Interim Secretariat for the United Nations Framework Convention on Climate Change, the United Nations Institute for Training and Research (UNITAR) and the Foundation for International Environmental Law and Development (FIELD). These were held in conjunction with the Global Conference on the Sustainable Development of Small Island Developing States, Barbados, 25 April to 6 May 1994;
(b) Forum sur la diversité biologique et les ressources phytogénétiques de l'Afrique francophone (Forum on Biological Diversity and Plant Genetic Resources in French-speaking Africa), organized by the Ministry of Environment of Canada, the Agency for Cultural and Technical Cooperation (ACCT) and the Government of Côte d'Ivoire, held in Abidjan, Côte d'Ivoire, 30 May to 4 June 1994;
(c) Regional Conference on Biodiversity Conservation for the Asia and Pacific region, convened by the Asian Development Bank in collaboration with the World Conservation Union (IUCN), in Manila, Philippines, 6 to 8 June 1994;
(d) International Consultation on Biological Diversity (South-Asian Association for Regional Cooperation, Association of South East Asian Nations and other regional countries of the region), convened by the Government of India, in Bangalore, 22 to 23 August 1994;
(e) Workshop on the Practical Implementation of the Convention on Biological Diversity in the Baltic Region, convened by the UNEP Regional Office for Europe (ROE), in Tallinn, Estonia, 16 to 18 October 1994;
(f) Regional African Ministerial Meeting on the Convention on Biological Diversity within the framework of the African Ministerial Conference on the Environment (AMCEN), convened by the UNEP Regional Office for Africa (ROA) in collaboration with the United Nations Economic Commission for Africa (ECA) and the Organization of African Unity (OAU), at Nairobi, Kenya, 24 to 26 October 1994.
19. Further details on the above regional workshops as well as on the meetings for Latin American countries and for Caribbean island countries, to be convened by the UNEP Regional Office for Latin America and the Caribbean (ROLAC) prior to the first meeting of the Conference of the Parties, are provided in document UNEP/CBD/COP/1/Inf.1.
20. Planning and fund-raising efforts are underway for future regional workshops for:
(a) Central and Eastern European countries;
(b) South Pacific islands;
(c) Asian subregions;
(d) Middle East.
21. In fulfilling its responsibilities, the Interim Secretariat developed close working relations with a range of competent regional and international organizations and with relevant non-governmental organizations.
22. In conformity with article 24 of the Convention and resolution 2 of the Nairobi Final Act, the Interim Secretariat held periodic discussions with United Nations entities, including UNITAR and the secretariats of partner organizations, in preparation for major meetings. In particular, the Department for Policy Coordination and Sustainable Development (DPCSD), the Food and Agriculture Organization of the United Nations (FAO), the staff of the Biodiversity and Biotechnology Unit, ROLAC, Environmental Law and Institutions Programme Activity Centre, the Conference and Governing Council Service of UNEP, and the United Nations Educational, Scientific and Cultural Organization (UNESCO) have been closely involved in supporting the Interim Secretariat in its preparation and servicing of the intergovernmental meetings referred to in paragraph 11 above.
23. The Interim Secretariat convened at its offices in Geneva on 2 December 1993 a meeting with representatives of FAO, UNEP and UNESCO to explore approaches to and possibilities for cooperation in the work of the Interim Secretariat and to prepare for the intergovernmental meetings related to the Convention. Similar meetings were held in Mexico on 14 April 1994 on the occasion of the Open-ended Intergovernmental Meeting of Scientific Experts, with FAO in Rome on 28 September 1994 and with UNESCO in Paris on 13 October 1994. The technical work and expertise of these agencies has been drawn upon as necessary in the course of the work of the Interim Secretariat.
24. This spirit of close cooperation is illustrated by the extension of the Interim Secretariat to include representatives from DPCSD, FAO, the United Nations Development Programme (UNDP), UNEP, UNESCO and IUCN in servicing the various meetings.
25. These agencies, along with the interim secretariat for the Framework Convention on Climate Change (IS/FCCC) and the Global Environment Facility (GEF), have also been involved in two technical workshops on "incremental costs" and "methodologies for estimating funding needs" organized by the Interim Secretariat to prepare its work for the intergovernmental meetings.
26. In response to the request of the Intergovernmental Committee at its first session, the Interim Secretariat made contact with a wide range of financial institutions other than the one operating the financial mechanism of the Convention on an interim basis. Those institutions include the African Development Bank, the Arab Bank for Economic Development in Africa, the Asian Development Bank, the Caribbean Development Bank, the Central American Bank for Economic Integration, the European Bank for Reconstruction and Development, the European Investment Bank, the Inter-American Development Bank, the International Financial Corporation, the International Fund for Agricultural Development, the Nordic Investment Bank and the World Bank.
27. Also at the request of the first session of the Intergovernmental Committee, the Interim Secretariat has established contacts with the industrial sector including agricultural, pharmaceutical, chemical, petroleum and other industries. Associations and organizations include the Business Council for Sustainable Development (BCSD), the International Chamber of Commerce (ICC), the International Petroleum Industry Environmental Conservation Association (IPIECA), the American Seed Trade Association, the International Fertilizer Industry Association (IFA) and the World Industry Council for the Environment (WICE). A first meeting with industry sector representatives (BCSD, ICC, WICE) was held at the offices of the Interim Secretariat on 10 May 1994.
28. The Interim Secretariat works closely with the Regional Offices of UNEP and draws on them to complement and support its work. The Regional Offices assist by communicating with Governments, supporting meetings, organizing regional workshops and providing liaison for discussions about regional issues.
29. Areas of cooperation have also been identified with some intergovernmental organizations and contacts have been established to discuss cooperation in the areas of data and information services, intellectual property rights, training and technical assistance.
30. Appropriate support has been extended to the non-governmental community at intergovernmental meetings organized by the Interim Secretariat. In addition, the Interim Secretariat liaised on a regular basis with non- governmental organizations and meetings have been held with organizations such as the Asian Wetland Bureau, Environment Liaison Centre International, International Academy for the Environment, World Conservation Union (IUCN), Swedish Institute for the Environment, South Centre, Third World Network and World Wide Fund for Nature (WWF), to explore collaboration. Many other organizations involved in work relevant to the Convention have been received at the Interim Secretariat to discuss issues of mutual concern.
31. The Interim Secretariat paid particular attention to the need to establish and strengthen close working relations with the secretariats of international legal instruments relevant to the objectives of the Convention and, in particular, the secretariats of conventions related to biological diversity.
32. The Interim Secretariat participated in the first meeting on coordination of secretariats of environmental conventions, convened by the Executive Director of UNEP from 28 to 30 March 1994 in Geneva. The objective of the meeting was to promote the coherent coordination of the functioning of environmental conventions in accordance with Governing Council decision 17/25 of 21 May 1993, and generally in conformity with UNEP's mandate as stipulated in paragraph 22(h) of chapter 38 of Agenda 21.
33. In carrying out its activities, the Interim Secretariat has felt the need to develop a coherent understanding of existing biodiversity-related conventions in order to identify relationships with the Convention on Biological Diversity. It therefore organized a series of meetings with each relevant convention secretariat to analyse the complementary nature of the work and identify scope for cooperation. Meetings have been held with the following convention secretariats: Convention on the Conservation of European Wildlife and Natural Habitats (Bern Convention), Convention on the Conservation of Migratory Species of Wild Animals (Bonn Convention), Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES), and Convention on Wetlands of International Importance Especially as Waterfowl Habitat (Ramsar Convention) and the Convention Concerning the Protection of the World Cultural and Natural Heritage. During these meetings, the scope and nature of each international legal instrument of direct relevance to the objectives of the Convention on Biological Diversity was examined. These exploratory meetings have demonstrated the need for continuing structured discussions with a view to establishing appropriate forms of cooperation, creating synergies and avoiding duplicative programmes.
34. The Interim Secretariat participated in the symposium held in Monaco from 26 to 28 September on "The United Nations Conference on Environment and Development, the Biodiversity Convention and the Bern Convention". It was also represented at the ninth meeting of the Conference of the Parties to CITES, held in Fort Lauderdale, United States, from 7 to 18 November.
35. Regular discussions are held with the secretariats located in the same headquarters as the Interim Secretariat, including the Secretariat of the Basel Convention on the Control of Transboundary Movements of Hazardous Wastes and their Disposal.
36. The participation of the Interim Secretariat in the different sessions of the Intergovernmental Negotiating Committee for a FCCC, and in a number of the preparatory technical meetings of the Intergovernmental Negotiating Committee for the elaboration of an international convention to combat desertification in those countries experiencing serious drought and/or desertification, particularly in Africa, has provided the opportunity to strengthen relationships with their respective secretariats.
37. The above-mentioned consultations with the convention secretariats directly related to biological diversity have highlighted the need to ensure that their activities and those undertaken under the Convention on Biological Diversity are mutually reinforcing. Accordingly, an in-depth study of the potential synergy among biodiversity-related conventions, for presentation to the second meeting of the Conference of the Parties, has been proposed in the work programme for 1995 of the Secretariat to the Convention on Biological Diversity. It is felt that such an analysis could guide the Conference of the Parties in its approach towards achieving the objectives of the Convention on Biological Diversity. It will also provide a basis upon which these conventions, their Parties and their secretariats might achieve greater coherence and effectiveness.
38. At 30 August 1994, 82 States and the European Community were Parties to the Convention (see UNEP/CBD/COP/1/Inf.4).
39. The Interim Secretariat continually interacts with Governments through Permanent Missions to the United Nations, in particular in Geneva and Nairobi, about work in progress and relevant issues under the Convention. The Committee of Permanent Representatives in Nairobi, and the Environmental Exchange Network in Geneva are briefed by the Interim Secretariat whenever possible about activities carried out under the Convention. The Interim Secretariat organized in Geneva and in Nairobi a series of briefing meetings with Permanent Representatives in order to prepare for the second session of the Intergovernmental Committee on the Convention on Biological Diversity. Similar preparatory meetings are being held prior to the first meeting of the Conference of the Parties.
40. The Interim Secretariat liaises with Governments upon request, on a case-by-case basis, either at informal meetings held in Geneva or through receiving government representatives at the offices of the Interim Secretariat.
41. The Interim Secretariat has been represented at major intergovernmental meetings of direct relevance to the objectives of the Convention. Particular attention has been paid to meetings of the interim financial mechanism of the Convention. The list of meetings attended by the Interim Secretariat between 1 October 1993 and 30 September 1994 is contained in annex II.
42. While on duty travel, staff of the Interim Secretariat have taken the opportunity to meet with Governments to discuss the work undertaken under the Convention, and to represent the Convention whenever the opportunity permits. Staff have also met with senior government officials of several Parties and signatories to the Convention.
43. To promote the Convention, the Interim Secretariat established close cooperation with the Information and Public Affairs Branch of UNEP as well as with the Department of Press and Information of the United Nations. Between September and 31 December 1993, six news releases were issued to promote the Convention and report on major events in relation to it. To mark the entry into force of the Convention on 29 December 1993, the Interim Secretariat issued a poster and a news release to facilitate coverage by the media. A January- March 1994 information sheet focused on the entry into force of the Convention. During the second session of the Intergovernmental Committee three press releases were issued. As mentioned in paragraph 10 above, two short-term consultants were contracted to conduct analyses of the Interim Secretariat's information and communication needs, taking into account its existing activities and the scope of future activities.
44. Contributions by the Interim Secretariat have been made to various publications. For example, the Executive Secretary wrote a foreword to the book "Widening Perspectives in Biodiversity", including papers presented to the meeting of the Global Biodiversity Forum in October 1993. The Forum organizers distributed the book widely and copies were made available to the participants in the second session of the Intergovernmental Committee. Other contributions have been made, inter alia to UNDP's "Partners", in the form of an interview, to the World Conservation Union (IUCN) "Biodiversity Update"; to UNEP's "Our Planet", and to the CITES/C + M International Magazine.
45. The Interim Secretariat is one of the partners in the innovative research project ELADA 21 (Electronic Atlas of Agenda 21), which will amalgamate multimedia and geographic informatics technologies, sponsored by the International Development Research Centre (IDRC) of Canada. The atlas will offer effective tools to assist policy and decision makers in the implementation and monitoring of related Agenda 21 projects and programmes. A user-friendly package is being developed on the chapter of Agenda 21 dealing with biological diversity.
46. Working Group I of the Intergovernmental Committee at its second session noted that article 40 of the Convention stated that the Interim Secretariat would function until the first meeting of the Conference of the Parties and that some time would be needed beyond that meeting for the organization or organizations designated to carry out the functions of the secretariat to make arrangements for its establishment. The Working Group agreed that the Committee should recommend to the Conference of the Parties the extension of the Interim Secretariat's term beyond the first meeting of the Conference of the Parties for as long as it was essential to ensure a smooth transition to the secretariat and maintain the continuity of work (UNEP/CBD/COP/1/4, paragraph 121).
47. In addition, at the 9th plenary meeting of the second session of the Intergovernmental Committee, on 1 July 1994, a number of representatives expressed the view that further consideration needed to be given to the designation of a permanent secretariat and that it might not be possible to complete that process at the first meeting of the Conference of the Parties. The Committee consequently recommended that the selection of the secretariat be addressed at the second meeting of the Conference of the Parties, and that the Interim Secretariat should continue its functions until that time, given the high quality of its performance (UNEP/CBD/COP/1/4, paragraph 122).
48. Accordingly, and subject to endorsement of the Intergovernmental Committee's recommendation by the first meeting of the Conference of the Parties, the Executive Director, in light of administrative requirements and the need to ensure a smooth transition to the secretariat, has made the necessary arrangements to extend the Interim Secretariat's term to 31 December 1995.
49. It should be noted that during the interim period the potential scope, volume and complexity of the issues which arise under the Convention have emerged in greater clarity and detail. The operation of the Intergovernmental Committee and of the Interim Secretariat itself, in preparing the work for the first meeting of the Conference of the Parties, has enabled the tasks ahead to be conceptualized and outlined in a structured, if preliminary, manner. The volume and urgency of the work of the Conference of the Parties and its secretariat and other organs will be very demanding if the momentum of the Convention is to be sustained, and if the numerous priorities and needs of parties are to be addressed systematically and effectively. It will be important for the first meeting of the Conference of the Parties to ensure that, in establishing the organs and mechanisms under the Convention, an adequate basis is provided for supporting what is widely acknowledged to be a vitally urgent but very complex Convention.
50. The generous contributions of many Governments, institutions and individuals - whether financial or in- kind support, inputs, cooperation or time - are gratefully acknowledged by the Interim Secretariat.
