The resumed ninth meeting of the Ad Hoc Open-ended Working Group on Access and Benefit-sharing (ABS) of the Convention on Biological Diversity (CBD) was held from 10-16 July 2010, in Montreal, Canada.

Negotiations in Montreal focused on the draft protocol tabled by the Working Group Co-Chairs in Cali and revised during that meeting (Cali Annex). Delegates conducted two readings of the text, in order to isolate and resolve outstanding issues and reach consensus on language, with the aim to finalize the protocol in time for its possible adoption at the tenth meeting of the Conference of the Parties (COP 10), to be held from 18-29 October 2010, in Nagoya, Japan.

The closing plenary convened at 4:30 pm. The Working Group adopted the report of the meeting and the draft protocol on ABS; and decided to hold another negotiating session before the COP, tentatively scheduled for September 2010, in Bangkok, Thailand. Following regional group statements and the customary exchange of courtesies, Working Group Co-Chair Tim Hodges (Canada) acknowledged the important role played by Earth Negotiations Bulletin in the process and suspended the meeting at 6:47 pm.

Delegates met in the inter-regional negotiating group throughout the day and into the evening, to address benefit-sharing and access on the basis of the revised draft tabled on Tuesday, and the preamble on the basis of the Cali Annex. Informal groups met on compliance with mutually agreed terms (article 14) and on the concept of utilization in the context of benefit-sharing (article 4.2). A closed meeting of regional representatives was held in the afternoon.

Monday, 12 July 2010

Delegates met in the inter-regional negotiating group throughout the day and into the evening. They addressed provisions of the draft protocol contained in the Cali Annex (UNEP/CBD/WG-ABS/9/3, Annex I) on access to genetic resources, access to associated traditional knowledge, research and emergency situations, contribution to conservation and sustainable use, transboundary cooperation, traditional knowledge associated with genetic resources, national focal points, and ABS clearing-house and information sharing. Informal groups met on the relationship with other instruments, and derivatives.

Delegates met in the inter-regional negotiating group throughout the day and into the evening. They addressed provisions of the draft protocol contained in the Cali Annex (UNEP/CBD/WG-ABS/9/3, Annex I) on the protocol’s relationship with other agreements and fair and equitable benefit-sharing. Small groups were established on the relationship with other agreements, and derivatives.

Saturday, 10 July 2010

Delegates to the resumed ninth meeting of the Ad Hoc Open-ended Working Group on Access and Benefit-sharing (ABS) of the Convention on Biological Diversity (CBD) met in a morning plenary to hear regional statements and address organizational matters, including reconvening the inter-regional negotiating group established during the first part of the meeting in Cali, Colombia. In the afternoon, the inter-regional group started negotiating the draft protocol article by article.
