A/CONF.164/13:

The negotiating text prepared by the Chair says that a port State should take measures as are necessary to promote the effectiveness of international conservation and management measures. In the event that such inspection or other evidence discloses clear and reasonable grounds for suspicion that the vessel has undermined international conservation and management measures or has fished on the high seas without authorization, the port State shall inform the flag State and the requesting State, if any.
