A/CONF.164/13:

The negotiating text says that all States have the obligation to settle their disputes by peaceful means. In the event of a dispute of a technical nature, the States concerned shall refer the matter to an ad hoc panel of experts. Where all parties to a dispute are Parties to UNCLOS, the procedures for the settlement of disputes under that Convention shall apply. Regional or subregional fisheries management organizations or arrangements should strengthen or adapt the procedures for the settlement of disputes. If no settlement has been reached within a reasonable period of time, an arbitration procedure of the type described in Annex 2 of the Chair's negotiating text shall apply. Non-parties to regional or subregional management organizations or arrangements may invoke or submit voluntarily to the dispute settlement procedure established by the organization.
