IN THE CORRIDORS

There was discussion in the corridors after several African delegates in Working Group I commented that the regional implementation annexes would not be accorded the same legal status as the main Convention. According to paragraph 2 of Article 31 of the Vienna Convention on the Law of Treaties, "The context for the purpose of the interpretation of a treaty shall comprise, in addition to the text, including its preamble and annexes." Furthermore, Article 31 of the draft Convention also states that the Regional Implementation Annexes form an integral part of this Convention. Needless to say, there should be no doubt that the annexes are just as legally binding as the Convention itself.
